Well Mom Fitness Terms of Service Last Updated: 11 February 2026 Please read these Terms of Service ("Terms") carefully before using the Well Mom Fitness website and purchasing any of our fitness video courses. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website or services. 1. About Us Well Mom Fitness is operated as a sole trader business based in Lisbon, Portugal. Our instructor is Toral. We sell online fitness video courses which are accessible via streaming and/or download through our website. Contact: [email protected] 2. Acceptance of Terms By creating an account, purchasing a course, or using our website, you confirm that: You are at least 18 years of age (or the age of majority in your jurisdiction, if higher); You have the legal capacity to enter into a binding contract; You have read, understood, and agree to these Terms and our Privacy Policy; If purchasing on behalf of a business or organisation, you have authority to bind that entity to these Terms. 3. Products and Services 3.1 Course Content We offer fitness video courses delivered by our instructor Toral. All course content is provided for general fitness and wellness purposes only. Our courses are not a substitute for professional medical advice, diagnosis, or treatment. Before beginning any fitness programme, you should consult a qualified healthcare professional, particularly if you have any pre-existing medical conditions, are pregnant, recently postpartum, or have any physical limitations. 3.2 Access and Delivery Upon successful payment, you will receive access to your purchased course(s) in the following ways: Streaming: Access via your account on our website, available for as long as your account remains active and the course is available on our platform. Download: Where a downloadable version is offered, you may download the course files for your personal use. Downloaded files may be accessed offline on your personal devices. We will make reasonable efforts to ensure that course content is available without interruption, but we do not guarantee uninterrupted, error-free access. Scheduled maintenance or circumstances beyond our control may result in temporary unavailability. 4. Ordering and Payment 4.1 Placing an Order When you place an order, you are making an offer to purchase the selected course(s) at the price displayed. We reserve the right to decline or cancel any order, in which case we will provide a full refund of any payment received. 4.2 Prices and Currency All prices are displayed in Euros (EUR) and are inclusive of any applicable VAT (Value Added Tax) where required by law. We reserve the right to change our prices at any time. Price changes will not affect orders that have already been confirmed. 4.3 Payment Processing Payments are processed securely by Stripe, Inc. We do not store your payment card details on our systems. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy. In the event of a payment dispute, you agree to contact us in the first instance at [email protected] before initiating a chargeback. 4.4 VAT and Taxes As a business based in Portugal (EU), we comply with EU VAT rules applicable to the sale of digital services. For customers located in the EU, VAT may be charged at the applicable rate based on your country of residence. For customers outside the EU, no EU VAT is charged, though you remain responsible for any local taxes or import duties applicable in your jurisdiction. 5. Consumer Rights and Right of Withdrawal 5.1 EU and EEA Customers — Right of Withdrawal If you are a consumer resident in the European Union or European Economic Area, you have a statutory right to withdraw from a purchase within 14 calendar days of the date of purchase, without giving any reason ("cooling-off period"), subject to the exception below. Exception — Digital Content: In accordance with Article 16(m) of the EU Consumer Rights Directive (2011/83/EU), if you consent to the immediate delivery of digital content (such as streaming access or downloading a file) during the 14-day withdrawal period, and you acknowledge that you thereby lose your right of withdrawal, your right to cancel is waived upon access to or download of the content. At checkout, you will be asked to expressly confirm that you consent to immediate access and acknowledge the loss of your withdrawal right. If you do not grant such consent, access to the digital content will be provided after the 14-day withdrawal period has expired. 5.2 Refunds Where a valid right of withdrawal exists and has not been waived, we will process a full refund within 14 days of receiving your withdrawal request, using the same payment method used for your purchase. Outside the statutory withdrawal right, we offer refunds at our sole discretion. If you experience technical difficulties accessing your purchased course that we are unable to resolve, we will offer either a remedy or a full refund. We encourage all customers to review course descriptions carefully before purchasing. 6. Intellectual Property and Licence 6.1 Our Content All course content, videos, images, text, branding, and other materials on our website are owned by or licensed to Well Mom Fitness and are protected by copyright, trademark, and other intellectual property laws. The instructor, Toral, retains all rights in her likeness, performance, and original creative works contained in the course videos. 6.2 Your Licence Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the purchased course(s) for your own personal, non-commercial use only. This licence does not include the right to: Copy, reproduce, distribute, or share the course content with any third party; Upload, stream, or broadcast the content on any platform; Sell, sublicense, or commercially exploit the content in any way; Remove, alter, or obscure any copyright notices or branding; Use the content to create derivative works without our express written consent. 7. User Accounts If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must not share your account with others or allow others to access your purchased content through your account. We reserve the right to suspend or terminate accounts found to be in breach of these Terms. 8. Fitness Disclaimer and Health Warning Our fitness courses are designed for general wellness purposes. You acknowledge and agree that: You participate in all exercises at your own risk; You have consulted or will consult a qualified healthcare professional before commencing any exercise programme; You will not use our courses as a substitute for professional medical, physiotherapy, or nutritional advice; You will cease any exercise that causes pain or discomfort and seek medical advice if appropriate; Well Mom Fitness and Toral are not liable for any injury, illness, or adverse outcome resulting from participation in our courses. 9. Limitation of Liability To the maximum extent permitted by applicable law: Well Mom Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or courses; Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount you paid for the relevant course(s); Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded by law. If you are an EU consumer, your statutory rights under applicable consumer protection law are not affected by these Terms. 10. Availability and Technical Requirements We do not guarantee that our website or course content will always be available, uninterrupted, or error-free. We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice. You are responsible for ensuring you have a compatible device, browser, and sufficient internet connection to access streaming content and/or sufficient storage space to download course files. 11. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence if you are an EU consumer. EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr, to resolve disputes relating to online purchases. 15.
